A Decatur County man pleaded guilty to two felony counts of child molesting Thursday afternoon, but left court with the plea in limbo. "The Greensburg Daily News" is reporting that all parties involved in the case are questioning the legality of the potential sentence.
A report by Rob Cox says that Decatur Superior Court Judge Matthew Bailey was set to sentence 29-year-old Larry W. Knight, of Westport, to two 20-year sentences in exchange for a plea of guilty but mentally ill. As part of the agreement, Knight would have served 10 years in prison and 10 years on probation.
Bailey had ruled that Knight would serve the twin sentences concurrently, but Bailey, Brown and Jones were not sure whether Indiana sentencing statutes allow for half of a Class A felony-related sentence to be suspended and served on probation. Bailey granted a continuance until Aug. 13, by which time all hoped to have the question resolved.
Cox's report says that Knight admitted that he was guilty of having intercourse with a 12-year-old-girl and sexual contact with a 13-year-old girl. His report also noted that all parties agreed that a plea of guilty but mentally ill was appropriate, as Knight has spent some ten years in mental health facilities since age 15.
